Regulation Watch · Business Licensing · Indonesia. The amendment applies nationally to the allocation of metal-mineral and coal WIUP and WIUPK through the priority route and to the creation and administration of WPR and IPR. It directly affects eligible Indonesian mining business entities, cooperatives, small and medium enterprises, religious-organisation businesses, BUMN, BUMD, universities and provincial governments. A PT PMA or foreign investor should not assume that the priority route is available merely because it operates through an Indonesian company. Permen ESDM 18/2025 separately allows foreign-investment companies to participate in relevant auctions, while each priority category has its own ownership, purpose and documentary conditions.
Indonesia Rewrites Priority Mining-Area Allocation
Permen ESDM 12/2026 adds public allocation criteria and revised OSS verification for priority mineral and coal areas, while rebuilding provincial requirements for community-mining permits.

Who is affected
Foreign and domestic investors in mineral and coal projects, PT PMA and PT PMDN mining companies, directors, shareholders, beneficial owners, prospective WIUP and WIUPK applicants, cooperatives, small and medium enterprises, religious-organisation businesses, BUMN, BUMD, downstream-processing investors, universities, individual and cooperative community miners, provincial governments, and mining, OSS, land, spatial-planning, forestry, water, environmental and compliance teams.
Practical impact
Priority WIUP and WIUPK allocation must now use stated geological, community-benefit and regional employment criteria, with additional attention to nearby communities and downstream value creation where specified. Planned priority allocations must be published on the Ministry's official website. Priority WIUP applications are verified through the Ministry's official channel and OSS, and the related minister receives a 14-calendar-day administrative verification period. If that period expires without a decision, the Energy and Mineral Resources Minister may determine which application proceeds to further verification. The amendment also removes the former technical annexes for priority WIUP and WIUPK, so applicants should work from the amended operative articles and current official channels. For community mining, provinces must prepare the WPR management document, reclamation and post-mining plans, block announcements, public outreach, spatial approvals and environmental approval before issuing an IPR. Each individual or cooperative applicant must hold an NIB with the appropriate mining KBLI.
The Minister of Energy and Mineral Resources established Permen ESDM 12/2026 on 8 October and it was promulgated on 13 October in State Bulletin 2026 No. 690. It took effect immediately and amends Permen ESDM 18/2025, the implementing regulation for the current mineral and coal mining-business framework.
The amendment makes the basis for priority allocation more explicit. A priority WIUP must consider geological potential, economic benefit for communities and job creation in the region. It may also consider proximity to communities and domestic value addition or downstreaming. A priority WIUPK must consider geological potential, proximity to communities, community economic benefit and regional employment. The Ministry must publish planned priority allocations on its official website, creating a defined official point for opportunity monitoring.
The WIUP application route now combines the Ministry's official channel and OSS. Administrative verification by the related minister must be completed within 14 calendar days after filing. If no decision is made within that period, the Energy and Mineral Resources Minister may determine the application that proceeds to further verification. WIUPK priority verification remains through OSS. The separate 14-working-day approval or rejection provisions in the base regulation remain relevant after verification.
Permen ESDM 12/2026 deletes the former technical-guideline articles and Annex II and Annex IV part A for priority WIUP and WIUPK. Applicants should therefore rebuild their checklists from the amended operative provisions, the continuing eligibility and documentary rules in Permen ESDM 18/2025, the official allocation notice and current OSS instructions. Earlier annex forms should not be treated as controlling without confirmation.
The amendment also rewrites the community-mining sequence. A proposed WPR must satisfy environmental carrying-capacity and conservation criteria, provincial and regency or city spatial plans, commodity and depth conditions, and a maximum 100-hectare block size. After the Minister approves the WPR management document, the governor may issue an IPR for up to 5 hectares to an individual or up to 10 hectares to a cooperative. Each applicant must have an NIB with the relevant mining KBLI.
Before issuing an IPR, the province must prepare reclamation and post-mining plans, announce the block division, conduct outreach with local authorities and affected communities, facilitate spatial conformity and secure environmental approval. After issuance, it must facilitate any required forest-use approval, water-agency recommendation and other approvals. The governor is responsible for supervision of safety, environmental management and remediation and may appoint a state-owned, regional-owned or private business to process and refine metal mineral output from IPR operations.
The amendment does not reopen every priority category to every investor. Permen ESDM 18/2025 retains category-specific rules for cooperatives, local small and medium enterprises, religious-organisation businesses, university-linked projects and downstreaming projects. It separately recognises foreign-investment companies in the auction route. Foreign investors and PT PMA groups should identify the correct route and complete an ownership and eligibility review before acquiring, funding or restructuring an applicant.
Required action
- Monitor the Ministry of Energy and Mineral Resources website and OSS for the official notice of every planned priority WIUP or WIUPK allocation. Do not rely on informal notices or an earlier annex checklist.
- Confirm the applicant's exact eligibility category before committing capital. A PT PMA should separately test whether the opportunity is an auction or a priority allocation and whether the applicable ownership, local-presence, university-partnership or downstreaming conditions can be satisfied.
- Reconcile the applicant's NIB and mining KBLI, AHU record, shareholder and beneficial-owner data, tax identifiers, technical experts, exploration work plan, financing evidence and required commitments against the unchanged requirements in Permen ESDM 18/2025 and the amended verification route.
- Prepare evidence of geological fit, community economic benefit and regional job creation. For a WIUP priority case, also address nearby-community considerations and any domestic value-add or downstreaming plan relevant to the allocation.
- Map the new 14-calendar-day administrative verification period and the separate approval process in OSS. Preserve submission receipts, document versions, official communications and any request for correction or further verification.
- Keep the existing post-approval clocks in the base regulation on the compliance calendar: pay the data-information compensation and place the exploration commitment guarantee within 7 working days, then apply for the exploration-stage IUP or IUPK within 10 working days after approval.
- For an IPR project, obtain the correct NIB and KBLI and verify that the province has completed the WPR management document, block allocation, reclamation and post-mining planning, outreach, spatial conformity and environmental approval before permit issuance.
- Where a WPR touches forest or river-basin controls, track the provincial facilitation of forest-use approval, water-agency technical recommendations and other post-issuance approvals before mining begins.
