Marketplaces Must Cut Service Fees for Verified Domestic-Only UMK Sellers

Permen UMKM 3/2026 requires non-UMKM e-commerce platforms to give verified micro and small sellers of domestic-only products at least a 50% service-fee reduction and introduces mandatory partnership terms, fee-change notice, BPJS participation and enforcement controls.

Who is affected

Indonesian and foreign-owned e-commerce platforms and marketplaces classified as PPMSE; PT PMA and PT PMDN platform operators; directors, commercial, legal, product and seller-operations teams; and Indonesian micro and small enterprises selling goods or services online, including employers of workers seeking the regulation's protections and incentives.

Practical impact

The regulation creates a dedicated protection and partnership layer for UMK sellers in addition to the wider PMSE framework. From 17 December 2026, non-UMKM PPMSE must give at least a 50% reduction in service fees for every eligible transaction by a verified UMK that sells only domestic products, after the seller applies through SAPA UMKM. Ready-to-eat processed food and electronics made by large domestic industry are excluded from the discount. UMK-PPMSE partnerships must be written in Indonesian and contain ten minimum subjects, including all fees, payment timing, termination, disputes, force majeure and business development. Platform fee changes require at least 90 calendar days' notice, and changes during the contract term require agreement. To claim the regulation's protections, an UMK must meet conditions including NIB and SAPA UMKM registration, truthful information, domestic-product and transaction integrity, and active employee participation in BPJS Ketenagakerjaan accident and death protection and BPJS Kesehatan.

Permen UMKM 3/2026 was established on 15 June and promulgated on 17 June 2026 in State Bulletin No. 396. It generally took effect on promulgation, while the written-partnership, minimum-clause and service-fee incentive provisions in Articles 4, 5 and 15-17 begin six months later, on 17 December 2026.

The instrument applies to partnerships between micro or small enterprises and PPMSE, the electronic-commerce operators that provide the electronic communication facilities used for trade. This can include foreign-owned Indonesian marketplace operators. It supplements the broader PMSE licensing framework with seller-protection rules focused on fair contracts, fee transparency, transaction and account security, data protection, non-discriminatory platform treatment and access to dispute assistance.

From 17 December 2026, a non-UMKM PPMSE must provide a service-fee reduction of at least 50% for every eligible transaction by a verified UMK that sells only domestic products. The UMK applies through SAPA UMKM and the Ministry performs the verification. The discount does not cover UMK sales of ready-to-eat processed food or electronic products made by large domestic industry. A platform may refuse or stop the discount if the seller offers non-domestic products, but the seller may seek clarification or object.

The partnership must be written in Indonesian and can be physical, electronically signed or accepted through a provable electronic mechanism. It must remain accessible to the UMK and cover ten minimum subjects: identities, scope, rights and duties, term, fee types and amounts, payment method and timing, termination, dispute resolution, force majeure and business development. Every fee and its calculation must be stated. An in-term fee change requires agreement, and the platform must give at least 90 calendar days' notice before any changed fee takes effect.

The UMK side also has operational conditions. To obtain the protections, the seller must have an NIB, register in SAPA UMKM, provide truthful information, prioritize compliant domestic products, maintain good fulfilment and transaction conduct, and ensure that employees actively participate in BPJS Ketenagakerjaan accident and death protection and BPJS Kesehatan. These provisions should be read as eligibility and conduct conditions under this regulation, not as a replacement for the wider employment and social-security laws.

The Ministry will monitor implementation continuously and evaluate it at least annually. Based on that process, it may issue warnings or written reprimands, recommend competition supervision, publish the non-compliance, or recommend revocation of the business licence. Platforms should therefore preserve seller-verification, contract, fee-notice, consent, payment and transaction-level discount records rather than treating the 50% reduction as a purely promotional programme.

Required action

  • Platform operators should classify whether they are a non-UMKM PPMSE and identify every Indonesian micro or small seller relationship covered by the regulation, including sellers onboarded under a standard platform click-wrap agreement.
  • Before 17 December 2026, update Indonesian-language seller agreements to include the ten prescribed subjects: party identities, scope, rights and duties, term, fee types and amounts, payment method and timing, termination, dispute resolution, force majeure and UMK business development.
  • Build a fee-discount workflow for verified UMK applications through SAPA UMKM, apply at least a 50% service-fee reduction to each eligible domestic-product transaction, and keep the ready-to-eat processed-food and large-industry electronics exclusions separately identifiable.
  • Disclose every registration, service, promotion, advertising and optional-feature charge, its calculation and payment method; obtain agreement for an in-term change and give the seller at least 90 calendar days' notice before a changed fee takes effect.
  • Connect seller-support, account-protection, transaction-data, complaints, termination and payment controls to the new UMK rights, including no undisclosed deductions, no unjustified unilateral termination and access to relevant transaction information.
  • UMK sellers seeking protection or the discount should confirm their NIB, register in SAPA UMKM, document that eligible listings are domestic products, maintain reliable fulfilment and transaction records, and verify active employee coverage for BPJS Ketenagakerjaan JKK/JKM and BPJS Kesehatan.
  • Retain the seller's verification, application, product-origin evidence, contract version, fee notice, consent, transaction-level discount and any rejection or objection record for monitoring or a facilitated negotiation with the Ministry.
